Contest Rules 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.  

  1. Eligibility

  BIG IDEA CHALLENGE: AN EDUCATION INNOVATION CONTEST (the “Contest”) is open to legal residents of Nevada who are at least eighteen (18) years old at the time of entry. Employees of Andre Agassi Foundation for Education, the Engelstad Family Foundation, and other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates, and advertising and promotion agencies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee, are not eligible. Contestants are responsible for determining whether the eligibility limitations apply to them. The Contest is subject to federal, state, and local laws and regulations.  

  1. Sponsor

  The Contest is sponsored by Andre Agassi Foundation for Education, located at 1120 N. Town Center Drive, Suite 160, Las Vegas, Nevada 89144; and the Engelstad Family Foundation, located at 11105 W. Flamingo Road, Las Vegas, Nevada 89135.

  1. Agreement to Official Rules

Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. 

  1. Contest Period

  The first round of the Contest begins on April 17, 2023 at 9:00 a.m. Pacific and ends on June 9, 2023 at 11:59 p.m. Pacific (“Round One”). Round One entries that are submitted before or after Round One will be disqualified.

“Round Two” (semi-finalists) will be notified in July 2023, followed by a workshop with semi-finalists hosted by Nevada GrantLab on July 29, 2023. Semi-finalists will present to a panel of judges in October 2023, with finalists moving to “Round Three.” Winners of the Contest will be announced in December 2023.

Submissions will be accepted for the duration of the Contest online only by visiting our website (www.thebigideachallenge.org) and following the directions provided to fill out and submit the entry information. Entries must be received by the times outlined above to be eligible to win. 

  1. How to Enter

Contestants must complete and submit the official application form [LINK TO APPLICATION FORM], along with his or her full name, complete address, phone number (including area code), and date of birth and a video introducing himself or herself and describing his or her idea prior to the end of the Round One. Contestants must submit such application online, as described above. All entries for Round One must be received before the end of Round One. After Round One ends, any and all applications timely received will be reviewed by a panel of judges selected by, and in the full discretion of, Sponsor. If selected, contestants will be invited to participate in Round Two.

During Round Two, contestants must submit a formal business plan illustrating how such idea could potentially be brought to life. Contestants must submit such business plan online, as described above. All entries for Round Two must be received before the end of Round Two. After Round Two ends, any and all videos and business plans timely received will be reviewed by a panel of judges selected by, and in the full discretion of, Sponsor. If selected, contestants will be invited to participate in Round Three.

During Round Three, contestants must attend an interview, either virtually or in-person, with a panel of judges selected by, and in the full discretion of, Sponsor. After Round Three ends, the panel of judges will select a potential winner to be announced on or about December 1, 2023. The potential winner will be selected based on the following criteria: 40% creativity and practicality of his or her idea; 40% the potential such idea has to positively impact Nevada students; and 20% writing skill. The potential winners will be selected based on a majority vote of the judges on the panel selected by, and in the full discretion of, Sponsor.

Limit one (1) entry per person, per email address, and per household for the duration of the Contest Period, regardless of method of entry. Entries received from any person, e-mail address, or household in excess of the stated limitation will be void. All entries become the property of Sponsor and will not be acknowledged or returned. Notwithstanding the foregoing, all intellectual property rights, moral rights, copyright, reproduction rights, or similar rights of the authors or creators to the work submitted shall remain the property of the contestant unless purchased at professional rates independently of prizes and awards. 

  1. Prize Drawing

On or about December 01, 2023, the Sponsor will select potential winners. The Sponsor will attempt to notify the potential winner via telephone or email on or about December 01, 2023. If the potential winner cannot be contacted within five (5) days after the date of the first attempt to contact him/her, the panel of judges may select an alternate potential winner in his/her place from the remaining non-winning, eligible entries. 

  1. Winner Notification

    The potential winners will be notified by email, mail, or phone. Each potential Grand Prize winner (parent/legal guardian if a minor in his/her state of residence) will be required to complete, electronically sign, and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent in order to claim his/her prize. If a potential winner cannot be contacted, fails to submit the Declaration of Compliance within the required time period (if applicable), predeceases the disposition of the prize, or the prize is returned as undeliverable, potential winner forfeits the prize. If the potential winner is at least eighteen (18) but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winners behalf and fulfill any other requirements imposed on winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Official Rules. In its discretion, Sponsor may require winners to sign a release form in order to receive the prize. Winning is contingent upon fulfilling all requirements enumerated herein. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner selected based on a majority vote of the judges on the panel from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Prizes will be fulfilled approximately 8-10 weeks after the conclusion of the Contest. 

  1. Prizes

  Andre Agassi Foundation for Education and the Engelstad Family Foundation will award prize funds as set forth below. Judging of the applications and the selection of a winner, or winners, will be ultimately made by an esteemed panel of judges selected by, and in the full discretion of, Sponsor.

Grand Prize (5): up to five (5) potential Grand Prize winners will each receive $100,000.00 to be used solely in furtherance of the idea they proposed and submitted to the Contest and panel of judges. In the event the panel of judges selects, in their sole discretion, less than five (5) potential Grand Prize winners, the total prize funds may be reduced, reallocated or distributed equally among the selected Grand Prize winners, in the Sponsor’s sole discretion. If the panel of judges select no Grand Prize winners, Sponsor reserves the right to issue no awards.  Prize winners agree to maintain all receipts, invoices, documentation and other records evidencing the use and expenditure of prize funds for a period of three (3) years.  At the request of Sponsor, Prize winners will provide Sponsor a full and complete report on the use of prize funds, including (a) the name and address of prize winner; (b) the date and amount of the prize; (c) the purpose of the prize; (d) amounts expended by prize winner; (e) whether prize winner has diverted any portion of the prize funds from the purpose of the award; and (f) supporting documentation on the use and expenditure of prize funds.  Prize winners acknowledge and agree to provide the requested reports to ensure the prize funds are spent solely for the purpose for which awarded. The Sponsor shall maintain all records and reports required to maintain and continue expenditure responsibility and shall make such records and reports available to the Internal Revenue Service as may be required by law or regulation. If any prize funds are not used solely for the purpose awarded, the prize winner shall repay all such amounts upon request of the Sponsor and the Sponsor shall adopt reasonable and appropriate procedures to ensure that any prize funds so diverted will be repaid.  

Prizes are non-transferable and no substitution will be made except as provided herein at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.

  1. General Conditions

  In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human or computer intervention, or other technical problem, or in the event the Contest fails to receive adequate submissions or is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, Sponsor may, in its sole discretion, (a) suspend the Contest to address the impairment or technical problems and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; (b) terminate the Contest and award the prizes from among the eligible, non-suspect entries received up to the time of the impairment or technical problems; or (c) terminate the Contest and not award any prizes. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. 

  1. Notice

This Contest is void where prohibited. Participation in the Contest, where lawful, constitutes permission to use name, voice, photograph, or likeness of prize winners for advertising/publicity purposes without additional compensation. All tax liability on all prizes is solely the responsibility of the prize winner. The prize winner will receive an IRS Form 1099 if the prize value is over $600. 

  1. Release and Limitations of Liability

  By participating in the Contest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted, or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing, or typographical errors; (d) lost, late, incomplete, garbled, illegible, undelivered, stolen, damaged, delayed, postage-due, or misdirected mail, entries, or application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads, or in any Contest-related materials; or (f) injury, death, losses, or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. 

  1. Disputes

  Except where prohibited, each entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Contest, these rules, or any prize awarded shall be resolved individually, without resorting to any form of class action, and exclusively by arbitration in Las Vegas, Nevada in accordance with the rules of the American Arbitration Association; provided however, that a party may seek equitable relief as appropriate in state or federal court located in Las Vegas, Nevada. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants’ rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by and construed in accordance with the laws of Nevada, without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than Nevada. Judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction hereof. 

  1. Privacy 

  Information collected from entrants is subject to Sponsor’s privacy policy. The Sponsor shall maintain all submissions, Contest information, records and reports required for Sponsor to maintain and continue expenditure responsibility for prize funds and shall make such records and reports available to the Internal Revenue Service as may be required by law or regulation.
